Welcome to Alexandra's Archive. These Terms and Conditions ("Terms") govern your use of the website located at alexandrasarchive.com (the "Site"), and your engagement with Alexandra's Archive's services, the Built & Booked program, and template purchases.
By accessing the Site, engaging our services, enrolling in Built & Booked, or purchasing a template, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
In these Terms, "we," "us," "our," and "Alexandra's Archive" refer to Alexandra's Archive. "You" and "client" refer to the person or business using the Site, engaging our services, or making a purchase.
Unless otherwise stated, Alexandra's Archive and/or its licensors own the intellectual property rights for all material on the Site, including but not limited to text, graphics, logos, and design. All rights are reserved.
You may view and access the Site for your own personal or business research purposes. You must not:
We do not guarantee that the information on this Site is complete, accurate, or current, and we don't promise the Site will remain available at all times.
To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to the Site and its use. Nothing in this section limits or excludes liability for death or personal injury, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be excluded or limited.
Where the Site or its content is provided free of charge, we are not liable for any loss or damage arising from your use of it.
This section applies to custom branding, custom and semi-custom Showit website builds, VIP days, design retainers, and SEO services. It's a general summary — the specific pricing, deliverables, and deadlines for your project are set out in your individually signed Client Agreement, which takes precedence over this section for that engagement.
A non-refundable deposit is required to secure your project start date, to the extent permitted by Australian Consumer Law. This deposit represents the reservation of our time and covers administrative costs; no design work begins and no rights are granted until it's paid. Our standard structure is 50% upfront and 50% on completion, unless you've agreed to an alternative payment plan for your specific project. Late payments may incur a late fee.
If you cancel a project after work has commenced, you'll be expected to settle payment for any work already completed and a 20% cancellation fee applies; no refund is given in this scenario. Automatic termination without refund may also occur in cases of disrespectful or discriminatory conduct, an unresolvable dispute, or repeated unresponsiveness to requests for feedback or information needed to progress the project.
If your project needs to be paused due to unforeseen circumstances on your end, it may be paused for up to two months. You'll be billed for work completed to date, and resuming the project incurs a 20% restart fee. If the project hasn't resumed within two months, we may cancel it and refund the portion corresponding to work not yet completed.
If Alexandra's Archive is unable to complete a project due to illness, injury, or another unforeseen circumstance, you're entitled to a partial refund (minus work already completed), or a full deposit refund if this occurs before work has started.
Unless otherwise agreed, projects include two rounds of revisions. Additional revisions, or work that falls outside the agreed project scope, are billed separately at our standard hourly rate.
You're responsible for providing website copy, imagery, business information, and any completed questionnaires or pre-work in a timely manner, and for responding to feedback requests promptly (standard turnaround is within 2 business days). Each project has an agreed maximum completion date; if it runs over this date due to delays on your end, a 20% disruption fee applies for each week it runs over.
You're also responsible for the cost of any third-party services your project requires, including hosting, domains, SSL certificates, plugins, stock imagery, and font licenses, and for maintaining your own accounts and active licenses for these. You're responsible for proofreading all final assets, including spelling and contact details, before final files are generated; we're not liable for costs (such as printing) arising from errors found after sign-off.
To keep a clear project record, official communication is conducted via email or scheduled video calls, we don't manage projects via phone calls, SMS, or social media direct messages. All feedback, change requests, and approvals must be submitted through our provided feedback forms or by email; we're not responsible for requests made through other channels.
Design proofs are shared digitally throughout the project. Full, final files and usage rights transfer to you only once final payment is received; if final payment isn't made, the work remains the property of Alexandra's Archive, you're not permitted to use it, and no one, including you or another designer, may recreate it. Preliminary concepts and unused drafts remain our property.
Once you've publicly launched your completed project, you grant us permission to use and share it for our own self-promotional purposes, and we may share behind-the-scenes content throughout the project.
Completed websites include a "Designed by Alexandra's Archive" credit and hyperlink in the footer. This can be removed for a fee of $250.
You warrant that any materials you provide (images, copy, logos, etc.) are owned by you or that you have permission to use them; we're not liable for copyright issues arising from client-supplied materials. We don't perform formal trademark searches, it's your responsibility to confirm your brand name and logo are available for use in your industry and jurisdiction.
We don't guarantee search engine rankings, website performance, accessibility (WCAG/ADA) compliance, or business outcomes such as sales, bookings, or enquiries, these depend on many factors outside our control. We test your website for functionality, but can't guarantee it will look identical on every screen size or browser, as this varies with resolution and device. We're also not responsible for limitations of the website builder's own core code or platform-level performance (such as page load speed), these are outside our control.
Where you choose to override a technical or design recommendation we've made (for example, around colour contrast, font legibility, or image sizing), you accept responsibility for any resulting performance or accessibility issues.
You're responsible for your website's ongoing legal compliance, including privacy policies, cookie consent, and accessibility standards, as well as hosting, domains, and any third-party plugins used on your site.
Completed websites include a 30-day warranty from launch, covering bugs or errors we introduced (for example, a broken link or a misplaced image). This excludes issues arising from your own edits, third-party plugin or platform updates, hosting issues, or new/evolving accessibility and SEO standards. After 30 days, our obligations for the project expire; further requests are treated as new work, billed at our standard rate, and require a new written agreement.
This section applies specifically to Built & Booked, our two-week done-with-you website program.
Pricing, payment options, and enrollment terms are as stated on the enrollment page and payment link (processed via Stripe) at the time you apply and are accepted. By completing payment, you confirm that you accept these Terms.
All Built & Booked payments, including the core program fee and any VIP upgrade, are non-refundable once payment is made and these Terms are accepted. This applies regardless of your attendance or completion of the program.
Built & Booked requires active participation, including attendance at live calls (or catching up via replay) and roughly 5 hours a week of your own time to build and launch your website. We provide guidance, templates, tools, and feedback, but we do not guarantee any specific outcome, including bookings, enquiries, or revenue, as these depend on factors outside our control.
If you can't attend a live call, a replay will be made available to you. Program materials, templates, and tutorials provided as part of Built & Booked are for your own personal business use only and may not be redistributed, resold, or shared outside the program, consistent with our template license terms in Section 5.
This section applies to templates purchased through our Site via our embedded Shopify store.
This template is for personal and commercial use only. You may not resell, lease, license, distribute, or share this template or its contents in any way. You may not claim this template as your own creation.
All sales are final. Due to the digital nature of this product, no refunds or exchanges are offered.
Alexandra's Archive is not responsible for the legal requirements of your website or its content. It is your responsibility to ensure your website complies with all applicable laws and regulations.
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
We may update these Terms from time to time. We'll update the "Last updated" date above when we do, and continued use of the Site or our services after changes are posted means you accept the updated Terms.
